This page describes the general methods of processing personal data of the website’s users and cookies, referring to any specific sections where the site user can find specific information and any requests for consent (for individual processing). This information is provided only for this site and not for other websites that the user may consult via links. Zudek, as the Data Controller, is committed to protecting user’s personal information, and this document aims to help you understand what information we may collect and how we use it.

A) Processing Methods

This document is prepared in accordance with Art. 13 of EU Regulation 2016/679 (hereinafter: “Regulation”) to allow you to understand our privacy policy. It describes the general methods of processing the personal data of the website users and cookies, as well as how your personal information is managed when you use our website (hereinafter “Site”). The information and data you provide or otherwise acquire in using Zudek’s services, such as using the contact form, newsletters, etc., hereinafter “Services,” will be processed in compliance with the provisions of the Regulation and the confidentiality obligations that guide Zudek’s activities. According to the Regulation, the processing carried out by Zudek will be based on the principles of lawfulness, fairness, transparency, purpose limitation, data minimization, accuracy, integrity, and confidentiality. The data controller for the processing carried out through the website is Zudek, as defined above, to whom you can write for any information regarding the processing of personal data. This information is provided only for this website and not for other websites that the user may consult via links. B) Types of Data

Following website navigation, we inform you that Zudek will process personal data (Art. 4(1) of the Regulation), hereinafter referred to as “Personal Data.” In particular, the Personal Data processed through the Site are as follows:

1. Browsing Data

The computer systems and software procedures used for the operation of the website acquire, during their normal operation, some Personal Data whose transmission is implicit in the use of Internet communication protocols. This information is not collected to be associated with identified data subjects, but due to their nature, they could allow users to be identified. This category of data includes IP addresses or domain names of the computers used by users who connect to the Site, URI (Uniform Resource Identifier) addresses of the resources requested, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.), and other parameters related to the user’s operating system and computer environment. This data is used only to obtain anonymous statistical information about the use of the Site and to check its proper functioning (see the paragraph on cookies below), to identify anomalies and/or abuses, and is deleted immediately after processing. This data may be used by the competent authorities to ascertain responsibility in case of hypothetical computer crimes against the site.

2. Data Provided Voluntarily by the Data Subject

Apart from what is specified for browsing data, the user is free to provide the personal data reported in any request forms on the website (e.g., to request information, support, quotes, etc.). The failure to provide such data may make it impossible to provide the requested service. In these cases, only the necessary information for the requested service will be required (see specific information for details). When using certain website Services, there may be the processing of Personal Data of third parties sent to Zudek by you. With regard to these cases, you act as the independent data controller, taking on all the legal obligations and responsibilities. In this sense, you grant the broadest indemnity to Zudek in relation to any disputes, claims, requests for compensation for damage from treatment, etc., which may be received by Zudek from third parties whose Personal Data has been processed through your use of the Site, in violation of the rules on the protection of personal data applicable. In any case, if you provide or otherwise process Personal Data of third parties in using the website, you guarantee that this particular processing is based on an appropriate legal basis pursuant to Art. 6 of the Regulation, which legitimizes the processing of the information in question.

C) Purpose of Processing and Legal Bases

The processing of personal data that we intend to carry out, with your specific consent where necessary, has the following purposes:

1. Allow the provision of the Site’s Services; The legal basis for processing is the performance of pre-contractual measures taken at the request of the data subject (Art. 6(1)(b) of the Regulation) as the processing is necessary for the provision of the Service. Providing Personal Data for these purposes is optional, but the possible failure to provide it would make it impossible to activate the Services provided by the Site.

D) Interactions on Zudek’s Social Pages

Furthermore, your personal data may be processed for the following purpose:

Integration of the “user profile” in Zudek’s potential Customer Relationship Management (“CRM”) through interactions on social pages (e.g., messages and/or comments on Zudek’s Facebook page or on any other social environment or page of the Data Controller) to respond to requests for assistance or general information from the data subject.

The legal basis for the processing for the described purpose is found in the performance of a contract or of pre-contractual measures or in responding to requests of the data subject (Art. 6(1)(b) of the Regulation). The provision of your personal data for the above-mentioned purpose is optional, but failure to do so may result in Zudek being unable to fulfill your requests.

Details of the interactions made by the data subject on our social pages (e.g., messages and/or comments on Zudek’s Facebook page or on any other social environment or page of the Data Controller) may also involve further processing of your personal data for the purpose of defending against abuses and/or offenses and improving the support offered to our users who interact through our social channels, such as in the case of statistical and/or aggregate processing that allows us to better orient our communication strategies with online users. The legal basis for processing for the specific additional purpose described is the legitimate interest of the Data Controller (Art. 6(1)(f) of the Regulation) in managing the data of its users.

The data subject has the right to object at any time for reasons related to their particular situation to the processing of data for these additional purposes, unless the Data Controller demonstrates compelling legitimate grounds for the processing that override the interests, rights, and freedoms of the data subject, or for the establishment, exercise, or defense of a legal claim.

E) Recipients of Personal Data

For the above purposes, your Personal Data may be shared with:

Individuals authorized by Zudek to process Personal Data necessary to perform activities closely related to the provision of the Services, who have committed to confidentiality or have an adequate legal obligation of confidentiality (e.g., employees and system administrators).
Third parties responsible for managing the Site, who typically act as data processors.
Entities, authorities, or organizations to whom it is mandatory to communicate your Personal Data due to legal provisions or orders from authorities.

F) Transfer of Personal Data

Some of your Personal Data are shared with Recipients who may be located outside the European Economic Area. Zudek ensures that the processing of your Personal Data by these Recipients complies with the Regulation. Indeed, transfers may be based on an adequacy decision, on the Standard Contractual Clauses approved by the European Commission, or on another appropriate legal basis.

G) Your Privacy Rights under Articles 15 and following of the Regulation

In accordance with Articles 15 and following of the Regulation, you have the right to request Zudek, at any time, access to your Personal Data, rectification, or erasure of such data or to object to their processing. You have the right to request the restriction of processing where provided for in Article 18 of the Regulation, and you have the right to receive the Personal Data concerning you in a structured, commonly used, and machine-readable format in the cases provided for in Article 20 of the Regulation.

In any case, you have the right to lodge a complaint with the competent Supervisory Authority (Italian Data Protection Authority), as per Article 77 of the Regulation, if you believe that the processing of your Personal Data is in violation of applicable laws.

H) Changes

This privacy policy is effective from 20/10/2023. Zudek reserves the right to modify or simply update its content, in part or in full, also due to changes in the applicable regulations. Zudek will inform you of these changes as soon as they are introduced, and they will be binding as soon as they are published on the website. Zudek invites you to regularly visit this section to stay informed of the most recent and updated version of the privacy policy to be aware of the data collected and how it is used on the web platform.
